Aside from child-related matters, asset and debt division are the main issues in any divorce case. Indiana follows the “one pot” theory of marital property division. Under this theory, all property and debts are put into one pot, and the pot is divided equally (50/50) between the spouses. There are small nuances and exceptions to this. Many factors, such as the length of the marriage and how the property was acquired, can affect the ultimate division of the marital pot.
